Austrian Government Overturns E cigarette Sales Ruling

E-cigarette retailers in Austria sighed with relief. After a constitutional court overturned an e cigarette sales ruling. That amended tobacco laws that would have resulted in the sale of most e cig related products only for sale in officially licensed tobacco shops.

The Austrian government proposed that the sale of e-cigarettes be restricted to the Alpine republic's licensed tobacconists from October 2015. Hoping to protect the public and young people for health reasons.

Specialist Vaping St E-cigarette retailers in Austria have today sighed with relief. After a constitutional court overturned an e cigarette sales ruling to amend tobacco laws. That would cause the sale of most e cig related products to be only for sale in officially licensed tobacco shops.

Specialist Vaping Stores (sellers of e-cigarettes) opposed the e cigarette sales ruling. As it meant that they would have only been prohibited to sell the re-usable e cig devices. But not e liquid or disposable cigarettes.

Austrian supermarkets, restaurants, cafes and petrol stations are also allowed to sell cigarette products. But they must retail at a higher price than in the official-licensed tobacconists.

The e cigarette sales ruling angered many Austrian tobacconists. Claiming they should not be sold in ‘an uncontrolled manner’ "at any flea market". According to remarks reported by APA news. Ores (sellers of e-cigarettes) opposed the change. Because it meant they would only be prohibited to sell re-usable e cig devices. But not e liquid or disposable cigarettes.

The court ruled on Monday however, that the proposed amendment was unlawful. Saying the health arguments against e cigs and eliquids, were not concrete enough to warrant retailers' not being able to trade freely. That e-cigarettes should not be labelled the same tobacco products.

The Head of the e-cigarette association VFFED, Thomas Baburek. Owner of an e-cigarette shop said "We are relieved that we can carry on our business and don't have to shut up shop".
